Hola a tod@s, espero que me puedan dar una guia acerca del FP.
Mi esposo es EEA y acaba de llegar a UK y yo no estoy con él , vamos a solicitar el FP para mi. Tengo entendido que él tiene el derecho de residencia los primeros 3 meses y por lo tanto no es necesario que este ejerciendo treaty rights. Vamos a demostrar ahorros, nuestro matrimonio de casi 10 años, mi trabajo actual, mis honorarios. Él actualmente esta buscando trabajo

Me pregunto si alguien por acá ha aplicado dentro de esos 3 meses y como le fue? estoy en lo correcto de que nos puede ir bien? yo supongo que si pero quisiera alguna opinión de alguien que haya aplicado antes de los 3 meses de permanencia en UK. It is important not to test overall intentions in assessing applications for an EEA family permit. Also, there is an initial right of residence for 3 months, which means that an EEA national does not have to be exercising a treaty right immediately on arrival in the UK.

If the applicant is the spouse/civil partner of the EEA national or a dependant child of either the EEA national or their spouse/civil partner is under 21 then they do not need to provide evidence of financial dependency and therefore this should not be requested from the applicant.

Please note: because of the initial right of residence, the ECO cannot refuse someone on the basis that that their EEA national family member will not be a qualified person in the UK on arrival. However, if the ECO is satisfied that the EEA national has been in the UK for longer than three months, the ECO must be satisfied that the EEA national is a qualified person.
